Jury Rules Facebook Misled Users on Privacy in New Mexico

In a significant legal development, a New Mexico jury has ruled against Facebook, finding the company liable for misleading users about its privacy safeguards. This verdict marks another legal defeat for the social media giant, which has faced numerous lawsuits over its data policies.

Mass Violations and Potential Penalties

The jury identified over 43 million instances of Facebook breaching state consumer protection laws. The final financial repercussions for the company will now be determined by a judge, with state attorneys pushing for the maximum penalty of $5,000 per violation. This case represents a major win for consumer rights in New Mexico, holding one of the largest tech companies accountable for its actions.

The lawsuit stemmed from accusations related to a data breach involving a third-party quiz app that collected data from 87 million profiles. This data was subsequently used by Cambridge Analytica, a now-defunct political consulting firm, to influence targeted advertising in political campaigns, including Donald Trump’s 2016 presidential bid.

Facebook’s Defense and the Jury’s Decision

Despite Facebook’s arguments that the evidence presented by New Mexico was outdated, the jury sided with the state. Facebook insisted that only one other data breach was identified despite thorough investigations. However, the jury found that Facebook made deceptive claims about protecting user data and conducting investigations into third-party apps post the Cambridge Analytica scandal.

In defending its stance, Meta spokesperson Alex Burgos argued that the company has improved its policies and that the state’s claims were not reflective of current practices. Facebook also contended that it has adapted its systems to remove harmful content, including misinformation, asserting that the company has a right to manage its platforms in line with free speech principles.

Future Implications for Facebook and Meta

The impact of this ruling on Facebook’s financial standing remains uncertain, given Meta’s substantial profitability. According to Peter Ormerod, a law professor at Villanova University, even if the state secures the maximum penalties, it may not significantly affect Meta’s operations.

Should the judge impose the maximum penalties, Facebook could face over $200 billion in liabilities. However, the court will need to balance complex legal arguments from both sides to determine appropriate punitive measures. Previously, New Mexico secured a $942 million judgment against Meta for issues related to minors’ safety on its platforms.

The decision on penalties is expected in a hearing on October 1. Any awarded funds will support New Mexico’s education system. The state is also seeking an injunction to prevent similar incidents in the future. This verdict is part of a broader series of legal challenges facing Meta, including recent settlements and pending litigations.
