TikTok Settles $400M U.S. Child Privacy Lawsuit

The U.S. Department of Justice (DoJ) confirmed on Friday that TikTok, owned by ByteDance, has agreed to a $400 million settlement to resolve allegations from a 2024 lawsuit. The case claimed the company violated child privacy laws in the United States, marking a pivotal moment for digital privacy rights.

Settlement Details and Financial Breakdown

According to the settlement terms, TikTok will disburse $300 million immediately. An additional $100 million will be allocated once a prior consent decree involving TikTok’s predecessor, Musical.ly, is vacated, as stated by the DoJ in their announcement.

The original complaint, filed in August 2024 with the Federal Trade Commission (FTC), accused TikTok of engaging in widespread privacy violations by allowing children under 13 to register accounts and collect their data unlawfully in “Kids Mode.” Moreover, the complaint pointed out TikTok’s failure to honor parental requests for the deletion of their children’s accounts and personal information.

Response and Implications

At the time of the lawsuit, TikTok contested these claims, describing many as outdated or incorrect and noting significant changes had been made to address these issues. The DoJ highlighted this settlement as one of the most substantial recoveries under the Children’s Online Privacy Protection Act (COPPA).

The department acknowledged TikTok’s efforts to enhance safety measures for younger users, improve age-verification processes, and bolster parental control features. This development is seen as a critical advancement in safeguarding children’s online privacy.

Impact on TikTok and Broader Regulatory Landscape

Associate Attorney General Stanley E. Woodward Jr. lauded the settlement, declaring it a significant win for American families. He emphasized the importance of protecting children in digital spaces and ensuring companies adhere to privacy obligations. This settlement not only provides financial restitution but also reinforces expected privacy standards.

TikTok has faced similar regulatory challenges before. In September 2023, the company incurred a €345 million penalty for breaching the European Union’s General Data Protection Regulation (GDPR) concerning children’s data. Earlier this year, a legal arrangement permitted TikTok’s continued U.S. operations amidst potential divesture or ban threats.

This resolution underscores the increasing scrutiny on tech companies and their responsibilities regarding user data, particularly concerning minors. The outcome serves as a reminder of the growing global emphasis on enforcing stringent data protection regulations.
